So my little VO Rando rack just snapped on the first commute of the year. Went OTB, no injuries luckily. Not a nice start to Monday/the year.
This should be a straightforward warranty replacement from VO/Constructeur (who I bought it off) right? It’s only 3 months old.

Huw got back to me this afternoon, he’s going to replace the rack and get in contact with VO. I’m not sure if I want to run it again, but I might do so with mudguards when I’ve got some extra cash (has always been part of the plan). At least then if it snaps again it won’t drop right onto my wheel…

who’s got advice on this?
so the air conditioner in my car shat itself. i took it for service, not at the manufacturer, but at a manufacturer authorised service centre (top bloke, im not putting any names in because it might not help my case).
I mentioned the faulty aircon, he regassed it, confirmed it was cooked and said to take it to manufacturer to attempt a warranty claim (only manufactuer can process warranty and he didn’t want to wreck my chances - all g). i took it to manufacturer, on monday, recieved a call stating that the TX valve was faulty and would be replaced under warranty. on wednesday i recieved another call, stating that it was stone damage to the condenser and therefore not warranty.
I said no worries, i won’t get it fixed right now ($1260…) and paid them the $200 “diagnostic fee”. It’s $850 to get fixed at my bloke, and id rather pay him (and save myself money in the first place).
now here’s my issues.

the tx valve is warranty regardless of damage to the condenser, its upstream from the condenser and there is close to zero chance that it was damaged by the “stone damage” to the condenser. knowing this, the diagnostic fee i paid should have been negated with the replacement of valve under warranty.

the stone damage to the condenser is there, but i have my doubts as to whether it has actually punctured the refrigerant lines themselves, as it is very minor and only to the fins. (to be clear, this is a presumption, not confirmed, so we are still dealing in hypotheticals)

manufacturer did not remove my front bumper, so i doubt their ability to properly inspect the condenser and ‘diagnose’ it (i know this because i did this arvo and there was evidence that they didn’t).

they’ve left the skid plate off the bottom of my car, because despite taking $200 from me they can’t do their job properly.
so, my question is, if on wednesday i find that the condenser is not damaged by a stone chip in such a way that causes loss of refrigerant, and it is in fact a fault with the condenser in addition to the TX valve, how difficult/possible will it be to shit on manufacturer to refund not only the $200 diagnostic fee (this will be easy), but also to compensate me for the cost of the replacement, which i will be having done regardless*?
(i’m not about to screw around my mechanic with things i’ve had him special order in/the labour he will provide, he’s a small op and that kind of thing is a dick for cash flow)
ACCC says:
“You can seek compensation for damages and losses you suffer due to a problem with a product or service if the supplier could have reasonably foreseen the problem. This is in addition to your repair, replacement or refund rights.”
i have a problem with their service that has cost me money.
i’m also an asshole(if you deserve it) with an addictive personality so i can be really really annoying.

the service manager attempted to use the “he’s not a BRANDX certified mechanic, so is unfit to do the repairs”
when i showed him the highlighted excerpt from the ACCC dealer information for the car sale and service industry stating that what he just said was false and misleading (and restricted by the ACC) he lost a bit of his cock head attitude. still a cock head at the end though.

Fuck em. If you’ve got the energy and attitude to push it through, then go for it. As you’ve noted, they’ll do anything to avoid paying.
Chances are the guy you’re dealing with has got some KPIs he has to hit, and if you take it one or two notches up the chain you’ll get what you want.
saga still continues, old mate is still claiming that it isn’t warranty, but i’m now forcing him to attempt get it approved.
The outcome is irrelevant, it is warranty and i have more than enough evidence and multiple refrigeration/AC experts willing to attest as such, if it is approved he’s still going to be sad when i expect reimbursement, rather than a new and useless AC condenser. this is actually kind of fun, he’s gone from treating me like an idiot (“you don’t know what you’re talking about, the guys out there have years of experience”) when i first met him to being actually a bit scared to talk to me on the phone.
here’s a very small picture of the condenser. my copy is 16MP and the region of the leak can be expanded to over a foot wide. there is no stone damage there. i know where the leak is, based on a video sent to me directly from the service managers phone of them diagnosing it with soapy water with it out of the car. the ‘impact damaged’ area at the bottom of the condenser is standard, and as it has not breached a refrigerant core is purely cosmetic in nature.
so VW south yarra aren’t very good, VW australia by all accounts are, they’re reasonable and actually keep records of things.
long story short i won and i’m getting mah moneeeyz (all $1030.35 of it ).

Win, but frustrating that it took so much energy to get what you were entitled to.
What’s the interest of the service manager in rejecting your claim? Works for a big company subject to contractual and statutory warranties, where paying out claims is part of the business model, and where the company has insurance to cover just these sorts of claims. It has zero effect on the company, so why be a dick about it? If the company just processed all claims and only rejected those ones that were clearly not covered, they would save a lot of energy and some money too.
This is where companies like Officeworks, JB Hifi and some of the big department stores work well. Just wrap up processing returns and warranties with few or no questions asked as part of the business model.
Old matey probably has some short-sighted KPIs to hit and was hoping Asher would roll over on this. He would’ve made his initial call to reject and rather than accepting he was wrong decided to fight it.
I think what happened was just a series of cock ups that snow balled and old mate didn’t know how to respond.
they initially said it was warranty of the TX valve, despite me telling them it was the condenser leaking, they then realised two days later that the condenser was leaking(?!) and i think it was easiest for them to just call it stone damage, as 9 times out of ten it would be.
the tx valve wasn’t defective at all, but they put it on the quote for repair (which is kind of illegal, as they’d already called it warranty and would have been), and as they didn’t remove the front bumper/intrusion bar i know that they didn’t properly inspect the condenser (the leak was behind the intrusion bar). they also left a body panel off my car, and then didn’t tell me about it, which would have constituted a “defective service” anyway.
I think the biggest issue was the guy i spoke to when i returned to get the body panel didn’t understand how serious i was when i told him that i would be coming back to get my money if the condenser was replaced and it should have been warranty. he was a bit timid and maybe new in the position but didn’t really seem to know what to do, i think if in that case he’d deferred to the manager it might have been resolved then, but he didn’t. i also don’t think they’re used to people getting shit done quickly, i had the car actually fixed within 7 days and returned to them within 8, with very clear expectations of timing.
the manager also really didn’t appreciate me dictating how our meeting went, i think he’s used to being king of the hill and was very put out by being effectively told to be quiet, listen and act accordingly by someone 25 years his junior. i reckon ego played a big role in how that went, and well the dealer principle who i emailed is just a dickhead.
P.S. i only told the manager to be quit after he cut me off for the second time.
