Just to add to the frustration (from a fatality on April 6 last year):
No jail time for Lockhart driver who killed cyclist
… was convicted of negligent driving occasioning death in Wagga Local Court last month and was yesterday sentenced to an eight-month intensive correction order (ICO) and disqualified from driving for 18 months.
Magistrate Tony Murray said he viewed the offence as serious but took into account it was a momentary lapse in judgement
Victoria Police Online News Centre - Man charged with Ringwood hit-run
"The Kilsyth man faced 12 charges in the Geelong Magistrate’s Court this afternoon including dangerous driving causing death, failing to stop, failing to render assistance and theft.
Daniel Veerman was remanded in custody to appear at the Melbourne Magistrates’ Court on 26 May."
it just worked for the guy who drove through my ladyfriend at ~60kph.
i mean, she just has a broken limb, serious facial bruising, was unconscious for 5mins and has to take 6 weeks off work. but it was a mistake, so NBD…
a car is a dangerous object… it would be nice if the police recognised that.
I think the problem is with the law, not the police. Glad they caught the fucker…
I don’t know how I would handle that. Especially if they get away with it.
Once again I’d suggest violence, but dude you’re too cool and collected for that.
Maybe call the guy up and ask him to give her a massage or something.
rode that road jst 24 hours before this. lack of driver education needs as much work as the law.

So technically he should get 10 years maximum.
Crimes Act 1958 - SECT 319 Dangerous driving causing death or serious injury
(1) A person who, by driving a motor vehicle at a speed or in a manner that is
dangerous to the public having regard to all the circumstances of the case,
causes the death of another person is guilty of an indictable offence and
liable to level 5 imprisonment (10 years maximum).
Maximum Penalty in Victoria

License cancelled and disqualified for 2 years (1st offence), 4 years (subsequent offence)
Where the driver of a motor vehicle is involved in an accident, and that accident results in a person being killed or seriously injured, and the driver fails to give name and address and or fails to report accident to police: 80 penalty units, or 8 months imprisonment (1st offence), 240 penalty units or not less than 4 months and not more than 24 months imprisonment (subsequent offence). License cancelled and disqualified for 2 years (1st offence), 4 years (subsequent offence)
What gets me is that they don’t get permanently banned from driving. Driving is a privilege, not a fucking right. Too many people treat their 2 tonne death machine with flippancy, and don’t think about the damage they could potentially cause.
I keep thinking to myself that cars have their place: but the older I get, the more I wish we could get rid of them altogether. Modern culture reliance on cars just has way too many shitty consequences.
oh god. are you serious? i’m just sitting here shaking my head. that’s really effed up.
Oh shit, Nik. Did ^^this^^ just happen? I read it as a not-recent thing. That’s bullshit, hope she’s okay.
it happened 3.5 weeks ago.
she is doing well considering she has no memory of the time between stopping to turn right and waking up in an ambulance and spent over a week unable to use either hand properly (other wrist was badly sprained). those who saw her before the bruising went down on her face know that it was no light tap. she smashed the cars windscreen (with her body) though!
she is going to call the police to at least ask why they didnt press charges, but im betting its all a bit too hard. i mean she only had 2 rear lights (one of them a planet bike superflash), and reflective tape on her helmet, bag and bike. ahhhh… but it was dark and raining so thats ok. it was an ‘accident’.
UPDATE
Seems the offender is a junkie with mental health issues.
“…Ms Gibbons said there were some custodial issues in relation to Mr Veerman including the possible withdrawal from illicit drugs and possible mental health issues.”
This will be swept under the carpet, and another junkie will go free due to mental health issues. The government wont take a hard line on someone with mental health problems because they don’t do enough for that problem either.

I think that there is a LOT more to this story than is being reported at the moment. I have heard a few things floating about and I think more will come out over time.
I’m sure there is a lot more to this story, but this will become a non-issue as far as news is concerned, especially with the catastrophe in Japan. This is just another incident that will unfortunately disappear.
I am assuming you do not know either of these men. I happen to be in the position of friends knowing the victim and the offender. What you have written is very offensive. How dare you assume these things. You have no idea what has gone on and i would request you keep your opinions to yourself. I know this stretch of road very well and until Mr veerman makes public what happened i suggest you stop speculating.
If you knew the stretch of road you would know it is very dangerous for both riders and cars. do not assume that everyone who uses that defence it not telling the truth.
When is he planning on doing this?
Ok so it alawys the drivers fault? What about the riders who pull out in front of cars?
what about the riders who do not stop for red lights? what about the riders who do NOT follow the road laws? Yes my dad is a bike rider and has been for over 20 years. He has been hit twice by people who did not see him. so do not say i am being biased. on the other hand i am bike aware and have seen so many near misses due to rider negligence. Latest one ringwood bypass. rider went through red light tried to cross 3 lanes of traffic and car ended up screeching to a halt missing the guy with mm to spare. Let me guess it would have been the drivers fault. how about we place blame where blame is due. If mr veerman had been reckless enough to have hit the guy and seen him it would have been murder with an automobile. Obviously the fact that it is dangerous driving causing death means the police know it was accidental. The biggest problem was he freaked out and drove off. What would you do in the same situation? No-one actually knows until they are put in the same situation themselves.
