Worst fucking situation, so ridiculous… Was riding with a few friends some years back and one wasn’t wearing a helmet (bad, yes), we rode passed some boy toy in a little Rav 4 and he suddenly (driver) got super angry at my friend and decided his best course of action would be to hurl abuse and swerve into him going 40-ish… Friend managed to keep it steady but it kinda shows how stupid some people are…
Glad you’re okay, though. Personally it’s the more “disturbing” confrontations that stick with you the most… Just remember they’re not all like that I guess.
could probz sue, and charge him for attempted murder. lolz
Cops got him. The officer said that the most the driver will face is a reckless driving infringement. So f@#%ed.
On a slightly more positive note, the officer was pretty happy to attend a scene without any fatalities, “it’s a nice change to be at a scene with someone still alive”. He was from a special major collision division and only gets called out to the worst of the worse.
claim everything, get one for replacement of all broken bits (frame, seat, bars, bartape, pedals/straps would probably be damaged too), possibly even one for replacing the broken seat tube.
as for back on PT, i’m sure someone’s got a beater they could loan you…what size you ride?
Take him for everything you can get, he sounds like a nasty piece of work. Get a quote from a bike store, and then go to a few more till you get the highest quote, then send it to him.
Some arsehole ran straight through a stop sign and into my girlfriend last month, we made sure he paid dearly for his stupidity and negligence
If someone has something 52-ish square laying around, that would be really appreciated!
Wow, so sorry to hear of what crazy mofo’s there are out there.
I hope you recover quickly and that he gets everything he deserves.
Thanks guys. It’s times like these that show just how wonderful the cycling community we have here is. I went to Pista Bikes in South Yarra to get a quote and left with a short term ridable bike. John was really great, loaned me some gear until I get this whole mess sorted out. So darn generous and trusting. Really happy to be rolling again!
definitely go right through everything you had with you, clothes, bags + contents, i t-boned some douche who turned right last year, supermanned it over the bonnet, insurance companies screwed me on the bike, refused to replace it (Allegro Track, hard to come by I THINK NOT) and only offered wholesale value of the Felt Dispatch in cash, but they did pay out on all items on my calim, shirt, shorts, helmet, backpack, and a few weeks worth of public transport tickets, even if you’re not on pt get hold of some correctly dated tickets, was tempted to claim already broken camera also, but karma is a bitch!
Friend of mine got hit this morning crossing the road (red man, but traffic in the same direction had a green apparently). Bloke coming down the hill didn’t stop behind the line and knocked her over, apparently just sat in his car for a little bit looking annoyed as some other people got out and helped her get herself and bike off the road. Front wheel is completely fucked, maybe rear too. She didn’t get any number plate or phone number which is a bit of a bummer.
What’s the deal in this kind of situation? She’s not the one to pursue insurance, but who’s in the right (or I guess in this case, the “less-wrong”)? She was crossing against a red man, but he didn’t stop behind the white line (and must have had a bit of pace going over it to knock her off).
Oh, and no real injuries to report which is good.
Lesson is: cross against reds at your own peril.
Glad your friend didn’t get hurt though.
i was under the impression that even without a green man the pedestrian has right of way…?
i haven’t done any research into this however.
Really?
That just sounds shit.
Sounds French. Oh that’s not right,
Cars are always right in France. Everyone else is in the wrong.
For reference, Slater & Gordon page link to Cycling Claims…
This exact thing happened to me the other day - crossing on a red man (would have been green, but no-one pressed the button), corner gertrude and smith, car turns left from gertrude to smith and gently knocks me right over - it really looked as though he was slowing to a stop. No damage to me, but my front wheel is finished. If the law got involved, would I be the one at fault here? The guy must have been staring at his phone or something - hit me even though I was right in front of him.
Here we go again…
So i got doored on satruday night whilst riding up Sydney Rd (just south of blyth).
There was a group of people nearby who immediately came to mmy aid after i supermanned over the guys door.
I got the guys details, photo of the car, photo of my bike (the people were very good) and witness details.
Frame+fork are toast and helmet has a crack.
I called the guy on monday and he told me that he had no insurance and his solicitor was going to send me a letter to claim for the cost of his door repairs ($230) and i politely let him know that i had no plans to pay that as i was in the right.
sensing this was not going to be easy i stopped by the brunswick police station and asked what my options were and whether i needed to file a report although no-one was hurt.
the cop was nice and reinforced my research that the driver was definitely in the wrong, but that as no-one was hurt it they couldnt help and it was a civil matter.
i called the guy today after getting the estimate and he disputed my numbers (~1100 for equivalent/replacement parts). Apparently a frame and fork are only worth $200 as he has photos of my bike and checked. When i said i had written estimates that disagreed with that he descended into telling me to ‘GO F$$K YOURSELF’ repeatedly and not to call this number ever again.
So… anyone got a good Letter Of Demand they want to share? Or want to help me with one (especially if it comes with a good letterhead)? Happy to recompense…
I noted that earlier someone said i couldnt post it and it had to be delivered… does that mean i have to physically ‘serve it’?
I’m googling Letters of Demand in conjunction with this, but im looking for ones that have worked before.
Like i said. Base miles to his house. Firebomb. Base miles home.
Failing that, I’ll deliver the letter of demand for a packet of oreos.
k o is gonna be sooooo excited!!
nik, i’ll chat to some of the lawyers here who deal laregely in civil matters. several of them ride too.
