Yeah I’ve documented all calls and contact ect. I had a really nice police officer so maybe I should get him to call him and just explain the facts, trying to avoid court but will use it as a last resort.

He works for an independent cab company called telecabs so he owns the car and just uses the system.

What I should have done is gotten photos of the damage at the scene, I didn’t have a phone camera or anything but it would have quashed all this bullshit about me not having lights/damaging parts of my bike on purpose ect…

I reckon he’s trying to scare you, call his bluff and start the court proceedings* (don’t worry, a small claim like this won’t appear like an episode of Law & Order.) Looks like he’s trying to avoid an insurance claim, I think a court appearance may change his mind.

Get a law-minded friend to write you a well worded legal letter, even if it is addressed by you. Address the potential issues and relevant legal codes and it’ll scare the shit outta him.

If he doesn’t want to spend $600 bucks on parts for you I doubt he has the impetus to spend triple that on a lawyer and court procedures.

Yeah good call. You could also go to one of those community legal centres - I’ve used them in the past and managed to save myself thousands.

Dude walked out onto the bike path from a pub whilst on the phone. I tried to avoid hitting him and went down hard. In the end he pissed off into a car driven by the only 2 witnesses. I’m Ok, very grateful for my helmet. Bike not so good.

Sucks about the bike. I was really loving riding it, and just what I needed to get back into riding regularly again. I still can’t figure out what actually happened as it was a split second thing.

The shitty part is what happened afterwards with the pedestrian dude. Can’t go into much detail but the police have said there’s not a lot I can do as there wasn’t another vehicle involved, and he wasn’t the owner or driver of the vehicle he got into with his friends who witnessed the whole thing. Even the girls driving weren’t the owners of the car and it looks like it’d need a miracle to find out who the pedestrian is.

I’d juts like him to know that he has a duty of care if he’s caused an accident … and a few other things.

And I’d been so good. Lights, Hi Vis clothing, obeying traffic rules etc … Anyway, I’m all good and so grateful for my helmet. Keep safe folks :wink:

Kind of on the other foot. On Saturday I was coming down a hill quite quickly, it is olive season in the hills and I left my braking late to avoid a slippery patch of olives. Long and short of it I left my braking too late and went into the corner with too much speed. Looking at a car on the other side of the road I braked hard mid corner skidding the rear and then correcting to find myself on the roof of the car. I caused quite a bit of damage to the car (3 panels including the roof). I am heading to the police station today to report the incident, but have had a couple of sleepless nights thinking about the expense of fixing the car as I have no bike coverage. Will my public indemnity for my house cover this kind of incident?

aww crap. i have paid $900 for a three panel respray of a car i rode into in traffic while a little sleep deprived. bad feeling, but debts need to be paid. unfortunately roof damage on cars is a big cost, like maybe a writeoff? bicycle victoria covers car damage over $1000, which is probably the best reason to be a member. i guess cause you’re from adelaide you’re not a member, but any cycling association you may be a member of may cover you for damage during training rides etc.

A bit of an up date. My public indemnity insurance covers the damage caused to the car ($6,500.00) and I may have accidental damage cover on my bike. my broker is working it out now. So apart from the broken toe all is good.

Okay, so last night I was hit twice… Twice by the same car.

I had just commenced my usual bicycle commute home south along Sydney Road towards the city.

While cycling across the intersection of Sydney and Dawson Roads in the left-hand Lane, I was swiped by taxi. He initially only clipped my bars and I managed to keep it upright (had to swerve hard left). There was another car in the right-hand south bound lane of Sydney Road trying to make a right-hand turn into Dawson Street. The taxi switched lanes from right to the left lane and into me, without indicating I might add… Damn taxi drivers.

I continued down Sydney Road a short distance with the taxi until it stopped outside Sammy’s due to traffic. I pulled up along-side the taxi and came to a stop positioned around the front-left of his vehicle with the intention of getting the driver to pull over once the traffic started flowing again, so we could exchange details and I could hopefully get an apology. I said “you just hit me, you could have killed me”. He replied with aggression and started yelling at me, “what are you doing”. He then yelled out “get out of the way” and just drove straight into me. Yes that’s tight, he intentionally ran me over!

Luckily when his car made contact the bike was spun in a counter clockwise direction, flinging my body away from the car or I would have went under his car like the back end of my bike did. I still had my right foot strapped in too. Was rather tangled. Pretty sure he only stopped after this attempted exit manoeuvre because he was dragging me and my bike.

The driver didn’t apologise or get out to check if I was okay. He just kept on yelling that I move my bike out of the way.

A police car just happened to drive past a minute or so after he hit me the second time. I was a bit of a mess, didn’t follow my mentally rehearsed procedure of collecting witness names, contact details and taking photos. The officer was really nice and seemed to do decent job, talked to at least one of the witnesses. It’s not everyday someone willingly tries to kill you with their car, well for me anyway. Physically I’m okay, nothing major, nothing broken, just a bit sore. I had the police officer drive me to Royal after everything settled down just to get checked out and get TAC paper work though.

Trying to work out what I can claim. Bike is currently unridable. Frick, back to PT for a while. From my initial inspection the rear wheel is totalled, there is a small crack in the seat tube around the clamp area (unknown vintage lugged steel track frame), ti railed regal seat is ripped, bars + rear fender scuffed. Do I just take it down to a bike store and get them to write up a quote for repair/replacement?

Get a bike store to quote you but get more than one, I’ve gotten three so far. Claim everything to do with the accident.
