send the shop an email saying you have the frame and your money. If they wish to have the frame back they should make arrangements to have it shipped to them as you will not be paying for it. Request confirmation within a specific time period otherwise you will consider that they do not want the frame back.

I say this because I wouldn’t want them asking for the frame back if you’ve already moved it on.

Don’t rely on paypal, when they say ‘case closed’ they mean for them but possibly not you.

What NY shop was it?
Also, I didn’t read the whole thread, so I may have missed something… but I think it sucks that the shop made a mistake and now you have a frame at their expense, and you’re boasting about it on the internet.

i think you should probably read the whole thread before you blame Dirtbag of boasting about it on the internet. the store failed to respond, their loss as far as i’m concerned

I think the ethical thing to do would be contact the store, tell them you have their frame and you’ve been issued a refund… get them to pay for postage and send it back, rather than selling it / making money off it, or keeping it.
I mean, the store made a mistake and didn’t respond to an email from paypal within 10 days, which could have just been a case of it been filtered straight to their junk box. I dunno… just my thoughts on the matter.

my stance comes from also being fucked around big time by a US based company that had awful customer service. i won’t go into it again but it wasn’t NY based and i ended up in a very similar situation as dirtbag, but with much less $$ involved.

dirtbag contacted them about it and they then received notification from paypal that they had an issue to deal with (i would think they’d be fully aware of their required response times if they regularly trade online). if it were my shop i wouldn’t be wanting $1100 to walk out the door without any follow up, from either paypal or the buyer…

It’s not like he hasn’t tried to do the right thing, he even contacted PayPal to see what should be done. I’m not going to repeat what has already been said in the OP, but it doesn’t actually say that PayPal tried EMAILING the shop, just that they tried contacting the shop. It could have been a phonecall.

As far as I’m concerned, if the NY shop really wanted their frame back, they would have returned PayPal’s contact.

Reading through this thread this morning provides a lot of food for thought. It can be hard to understand the whole story when i have tried to summerize it as best i can in a few paragraphs but i appreciate the opinions. Wouoldn’t hasve asked if i didn’t want them.

I do feel as though i have done my part and although, yes i could do more; part of the responsibility also falls on the shop in NY to follow up with me. They are supposdly running a business over there and it looks as though their book keeping is as good as their customer service.

I reckon you should give the frame to me to look after while the dust settles - you know just in case - that would help your karma problem.

Once you contact the shop again and say “hi, i’ve got your frame, want it back?” and they reply with “nah dude don’t need it”, i say sell it for the USD price but in AUD. As in, if it’s $USD900, then sell it for $AUD900. It’s an extra bit of money you didn’t have, and it’d help someone out who wants a nice frame, but may not afford paying for it and shipping it from the states.

Or you could do whatever the hell you want with it. That works too.

So basically, despite the protracted original sale, you bought two frames. Then you received two frames. Then you committed a clear cut act of fraud and got the money back for one.

Its theft, essentially.

but he was told the original sale fell through. so he made alternatie arrangements.

then, when they sent the frame anyway, even though he was told it would no longer be sent, they charged him for it.

he contacted paypal, as well as the company who sent him the frame, and they were unhelpful. in an effort to return the frame, he listed the item as damaged. that’s hardly fraud when he’s trying to get rid of the frame surely. that was the only way it could have been sent back. he spent months trying to get the company to take their frame back, even after he was reimbursed by paypal.

it’s hardly theft if the orginal owner won’t take it back.

i agree with floody, it is fraud. lying about the frame condition was an act of fraud, doesnt matter if is was trying to return it. he was trying to do the right thing but went about it the wrong way.

im going to say what a lot of people have said, and that is contact the store with a set time period for return of the frame.
its the right thing to do.
otherwise it will come back and bite you on the arse!
and if they dont claim the frame then you are in the clear. one free mash!

Lying to paypal in order to get the money back for his undamaged - albeit unwanted - frame is “hardly fraud”? Its EXACTLY fraud.

The way the shitty deal went down to begin with doesn’t take away from the fact he lied to paypal and now has two frames for the price of one.
